SOILMATE LLC PRIVACY POLICY

Effective as of October 1, 2022.

Soilmate is committed to protecting the privacy of our visitors and customers. The Soilmate Privacy Policy (“Privacy Policy”) describes the types of information that Soilmate collects from and about you when you visit our website, www.your-soilmate.com (“Site”), mobile applications, or communicate using other online or offline methods (collectively, the “Services”). This Privacy Policy also explains how Soilmate may use and disclose such information, and your ability to control certain uses of it. 

For the purposes of this Privacy Policy “Personal Data” means information that on its own, or used in conjunction with other information is capable of identifying, contacting, or locating a single person in context. Personal Data includes, but is not necessarily limited to, your name, address, email address, telephone number, bank or credit card information, etc. 

Our pick-up service requires the collection and processing of personal data in order to function. If you choose not to provide information that is necessary to provide a service, you may not be able to use some of our services or certain areas of our Sites. 

By using the Services or providing your email or other contact information via a contact form or sign up form you agree to the collection, use, and disclosure of your information as described in this Privacy Policy, and agree to the Soilmate Terms of Service (“Terms of Service”). If you do not agree, please do not access or use the Services. 

  

Information We Collect 
Soilmate is the sole owner of all information collected from you when you choose to share it with us on the Site. This may include when you use our Services or when using the Site, if you fill out forms, register or create an online account with or through the Services, purchase products, sign up for newsletters, text messages, or our email list, enter into sweepstakes or other promotions, fill out a survey, request customer support, or otherwise communicate with or contact us. The information we may collect includes your name, email address, pickup address, phone number and payment information (including credit/debit card number, CVV number, expiration date and billing address). We use this information to deliver the products or services requested, to enhance your user experience, and to improve the performance of the Sites. 

If you sign up for an email list, contest, or service from Soilmate, you will automatically be added to our email list. You may unsubscribe at any time by clicking “UNSUBSCRIBE” at the bottom of the email. 

 

Referrals 
If you choose to refer a friend for our Services, we will ask for and collect your friend’s contact information. This allows us to send a message to invite your friend to visit the site or sign-up for the services. This information is stored to send the referral invitations and to track success of our referral program. 

 

Analytics and Usage 
Whenever visiting or interacting with the Services, Soilmate, as well as any third-party advertisers and/or service providers, we may use technologies that automatically or passively collect information about your online activity. Generally, this may include, but is not limited to, information about your geographic location, your browsing behaviors while using the Site, the type of device or software you use, and your IP address. We use this information to keep track of analytics and for statistical purposes, to measure the Sites’ effectiveness, and to improve visitor experience. 

 

Data Retention 
Soilmate has no obligation to you to retain your Personal Data. We will retain a minimum amount of personal data for as long as you choose to remain on our email list or subscribe to the Service, including your name, your email address, pick-up address and payment information, and your behavior on our website, as applicable. For all other information, we generally retain information only as long as is necessary to fulfill the purpose for which the Personal Data was collected, resolve disputes, or as reasonably determined. 

 

Third-Party Providers & Analytic Technologies 
Soilmate will not sell, trade or rent your Personal Data to any third party; however we may share some data for the following reasons: to assist in operating the site, providing services to you, such as processing a payment, or sending an email, and conducting our business; and to law enforcement, government agencies, and other third parties, for complying with the law, enforcing our website policies, or protecting our or others’ rights, property, or safety. Some of these third-parties and service providers may use technology such as cookies, web beacons, pixel tags, log files, Flash cookies, or HTML5 cookies to receive, collect, and store information. 

We may also use third parties’ analytics and tracking tools to better understand who is using the Service and the Site, how people are using the Service, how to improve the effectiveness of the Service and related content, and to help us or those third parties serve more targeted advertising to you across the Internet. We do not have access to, or control over, these third parties’ use of cookies or other tracking technologies.

Assignment 
In the event that all or part of our assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign your Personal Data collected via the Site and the Service to the acquiring party.

Soilmate may use the information we collect from and about you for the following reasons: 

- To deliver products or services as requested and contact and communicate with you when necessary. 

- To respond to your requests related to our services. 

- To use and disclose your credit/debit card information only to process payments and prevent fraud. 

- To enhance your online experience and to review usage of the Site and Services and to conduct analysis to improve performance of the Site and Services. 

- To contact you with information, newsletters and promotional materials from Soilmate or on behalf of our partners and affiliates. 

- To provide you with targeted offers, and advertising on the Site, via email, text message or push notification, or across other websites, mobile applications, or social media. 

- To protect the security or integrity of the Services and our business, such as by protecting against and preventing fraud, unauthorized transactions, claims and other liabilities, and managing risk exposure, including by identifying potential hackers and other unauthorized users. 

 

Access & Opt-outs 
You may opt out of any future contact from Soilmate at anytime by clicking ‘unsubscribe’ at the bottom of our emails or by contacting us directly via the email address provided on our website. You may also contact us to request any of the following: changes to your personal data, to delete personal data we may have, inquire about the personal data or the use of your personal data. Any requests or inquiries sent will be processed as soon as reasonably practicable. We are not responsible for informing any third parties (which includes without limitation third-party service providers or partners) with whom we have already shared your personal data of any change requests, or removing information from or causing information to be removed from the records of such entities. 

 

Third-Party Content, Links, and Plug-Ins 
The Site may have links to other third-party websites that may have privacy policies different from our own. We are not responsible for the content or privacy policies of such third-party sites. We have no control over the data and information collected, stored or used by the third-party sites. We encourage you to read the policies of these third-party sites carefully. 

 

Public Forums 
Any information you choose to post and or disclose on public posting area (blogs, message boards, comment sections, etc.) becomes public information. Please use caution when disclosing personal information in public areas. We are not responsible for the use by others of the information you disclose in public posting areas. 

Data Security 
We have taken certain physical and technical steps to protect the information and data we collect from and about our customers, visitors and users of our Service and Site. Although we make every effort to ensure the security of our network and system, we cannot guarantee our security measures. We use third-party products and sites to secure and store your information and sensitive information, such as credit card data, is encrypted and transmitted in a secured way. However, any information you may provide is done so at your own risk. 

 

Legal Compliance 
Soilmate generally adheres to laws in the U.S. and attempts to follow rules to protect the personal data of all our visitors and users. We intend to always be in compliance with U.S laws concerning data privacy. Our Privacy Policy is intended to comply with the General Data Protection Regulation (GDPR), the Children's Online Privacy Protection Act (COPPA) and the California Consumer Privacy Act (CCPA). 

The site is not intended for use by any person under the age of 13 and Soilmate does not knowingly collect information from visitors or uses under the age of 13. Soilmate requires that you are at least 18 years of age to use the Site and the Service. If we learn that a child under the age of 13 has provided personal information, we will use reasonable efforts to remove such information. 

 

Revisions to this Privacy Policy 
We reserve the right, at our discretion, to change, add, modify, revise or remove portions of this Privacy Policy at any time. Any changes made will be posted on the Site and any current users will be notified. By continuing to use the Site and subscribe to the Service following any posted changes means you accept the changes.
